1. Description of Services and Fees

eSIM markets enables you to purchase, activate, download, and manage prepaid mobile data plans delivered via embedded SIM (eSIM) technology through our Platform. The Platform provides a unified interface where you can review active eSIM plans, monitor data usage, initiate subscription renewals or one-time top-ups, and manage account settings.

To use the Service, you must ensure that your device is carrier-unlocked, supports eSIM functionality, and is compatible with the Service. A stable internet connection, a compatible eSIM device, and one or more valid payment methods are required.

2. Your Representations and Warranties

By accessing or using eSIM markets, you expressly represent and warrant that:

• You are at least eighteen (18) years old;
• You possess the authority to bind yourself to these Terms;
• Your use of eSIM markets will comply with all applicable laws and regulations;
• You will not use eSIM markets for any unlawful, abusive, fraudulent, or unauthorized purpose;
• All information you provide is true, accurate, complete, and current;
• You will not infringe any intellectual property or other proprietary rights.

3. Purchase, Payment and Activation

By completing any purchase via the eSIM markets Platform, you enter into a binding sales agreement with eSIM markets. All fees are charged at the time of transaction using your selected payment method.

We accept multiple forms of payment, including major credit/debit cards, digital wallets, and Platform billing options. eSIM markets does not store payment credentials. All financial data is processed and stored exclusively by licensed third-party payment service providers.

Refunds and Cancellations

All sales are final once the eSIM has been provisioned. Except where required by local law, we do not offer refunds or credits for unused data, expired plans, or partial billing periods.

4. Termination

We may terminate your access to the Platform, Services, or your account immediately and without notice, for any reason, including if you breach these Terms or violate any applicable law.

Upon termination, all rights granted to you under these Terms shall immediately cease, and you must cease all use of the Services.

5. Code of Conduct

While accessing and/or using the Platform and the Services, you are explicitly prohibited from:

• Using the Platform and Services against any applicable laws;
• Using the Services to support or engage in any illegal activities;
• Using the Platform in a way that disrupts or prevents use by other users;
• Accessing without authorization any content to which you are not permitted to access;
• Making any commercial use of the Services without authorization;
• Using any automated means that accesses the Platform without permission;
• Disclosing private information to third parties;
• Falsifying or deleting copyright management information.

6. Intellectual Property Rights

The Platform and all content therein including but not limited to signs, text, graphics, pictures, information, data, software, functionality, website designs, and the trademarks are owned by eSIM markets and/or licensed to us and are protected through various intellectual property rights.

You are granted a limited use right to access and use the Platform and Services. However, eSIM markets reserves the right to terminate your access at any time.

7. Disclaimer of Warranties

YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. eSIM markets IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, eSIM markets EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

eSIM markets makes no representation or warranty that the Services will meet your requirements, operate without interruption or error, or be compatible with your devices, software, or network environment.

8. Limitation of Liability

In no event shall eSIM markets be liable for any indirect, incidental, special, punitive, or consequential damages, including without limitation lost profits, data loss, business interruption, or loss of goodwill.

eSIM markets's total aggregate liability for any and all claims shall not exceed the total amount of fees actually paid by you to eSIM markets in the one (1) month preceding the claim.

9. Applicable Law

These Terms and your access to and use of our Services will be governed by and construed in accordance with applicable laws. Any conflicts shall be settled according to the jurisdiction where eSIM markets operates.

10. Amendment

eSIM markets may amend these Terms at any time. The latest version of the Terms published on the Platform are applicable to all Users. You are responsible for checking the latest version published on the Platform.
